THE STATE CAN DEFINE, WITH A DIRECTIVE, THE TYPE OF ARBITRATOR IT REQUIRES
The president of the Arbitration Center, Rosa Bueno, made a statement for the magazine Semana Económica and indicated that “if the Office of the Chief of Cabinet of Ministers (PCM) issues a directive, it is possible to determine the profile of arbitrators the State intends to appoint in the disputes in which it is a party”.
“In this way, the change is made without greater regulatory complexity or over-regulation”, said Bueno de Lercari when consulted on the Bills that seek to prevent acts of corruption in arbitrations with the State.
